Buyer acknowledges that tendering a check that return for insufficient funds or is in any other way dishonored could result in civil and/or criminal liability and penalties attendant thereto. Buyer further acknowledges that if Buyer or his agent, employee or anyone acting on buyer’s behalf tenders a check that is dishonored for any reason whatsoever, Buyer will immediately, upon notice from the Auctioneer or Seller of the dishonor, tender a Certified Check equal to the amount of the dishonored check, plus a $35.00 service fee. Buyer’s failure to do so will result in a police report being filed and charges will be pressed accordingly.

TERMS AND CONDITION1.        EVERYTHING IS SOLD “AS IS, WITH NO GUARANTEES, REPRESNTATION OR WARRANTIES. There are no expressed or implied warranties of merchantability or fitness for a particular purpose whatsoever.2.        ALL SALES ARE SUBJECT TO A 15% BUYER’S PREMIUM. WHICE IS ADDED TO THE BID PRICE unless otherwise noted in auction brochure and advertising.3.        ALL ITEMS MUST BE PAID IN FULL ON DAY OF SALE4.         ALL ITEMS MUST BE REMOVED ON DAY OF SALE (unless otherwise stated in opening announcement), or they will be considered forfeited and become the property of Seller or Auctioneer.5.         ALL TRANSDACTION ARE SUBJECT TO FLORIDA SALES TAX UNLESS A COMPLETED AND CURRENT FLORIDA SALES TAX CERTIFICATE OF RESALE IS ON FILE AT THE TIME OF REGISTRATION. NO EXCEPTION!6.         The auction Company cannot be involved in any trading of merchandise between buyers. Buyer number cannot be shared or exchanged and tickets cannot be split. Any activity between buyers must be conducted off the auction premises.7.         Buyer herby agrees that any suit, action or legal proceedings arising out of or otherwise related to the auction shall be brought solely and exclusively in the courts of the State of Florida in and for Dade County, Florida, and consent the jurisdiction of such court in any suit, action or proceeding, and waive any objection that it may have to the laying of venue of any such suit, action or proceedings in such court. Further, the parties also acknowledge and agree that this Auction registration and all transactions contemplated by this Auction Registration shall be governed by, construed and enforced in accordance with the internal laws of the State of Florida without regard of principles of conflict of laws.8.         The Buyer, its agent, employee and/or parties acting on its behalf, specifically agree to hold harmless the Auctioneer, its officers, directors, and employees, from any injuries or damages arising from any activities associated with this auction, including, but not limited to, the removal of auctioned items from the premises. Further, Buyer agrees to indemnify Auctioneer and/or Seller from any claims brought by third parties against Auctioneer arising from or out of the auction that are in any way attributable to any acts or omission on the part of the Buyer.9.        The undersigned, in his/her individual capacity, personally guarantees payment of the gross bid.10.     In the event the Auctioneer or Seller are required to take any auction to enforce the terms of this Auction Registration, Auctioneer and/or Seller shall be entitled to recover from Buyer all of their reasonable attorney’s fees and costs. Reasonable attorney’s fees shall include those costs incurred prior, during and after litigation, including those incurred in any bankruptcy proceedings and post-judgment proceedings.11.     Buyer herby does not waive the right to trial by jury in respect to any litigation arising in connection with this Auction Registration or the Auction itself.12.     All parties signing this Auction Registration in any representative capacity represent that they have the authority to sign on behalf of such party or entity.13.     It is further acknowledged by the Buyer that this Auction Registration has been read and understood by Buyer before signing it and that the Buyer understands and consent to its contents.
